1.1 The sale of products (“Products”) through the Site constitutes a distance contract governed by Chapter I, Title III (Articles 45 et seq.) of Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”) and by Legislative Decree no. 70 of 9 April 2003, as amended by Legislative Decree no. 21/2014, by Legislative Decree no. 70/2003 on e-commerce, by Directive 2000/31/EC and by EU Regulation 2018/302 of the European Parliament and of the Council containing the rules on e-commerce.

They do not regulate the sale of products by parties other than greenvalleysa.it which are present on the Site through links, banners or other hypertext links.
GreenValley has no control and/or monitoring over the websites accessible via these links.
GreenValley is therefore not responsible for the content of such sites nor for any errors and/or omissions and/or violations of the law on their part.

WooCommerce provides Green Valley with the e-commerce platform that allows us to offer and sell our products to users.

2.1 Access to sales made through the Site is reserved exclusively for users over the age of 18.
2.2 The user acknowledges that, by accepting the general conditions of sale, he/she releases GreenValley from any liability deriving from the purchase of the product if it is in violation of the law of the country where the product is sold.
The user is also obliged to find out whether the law / standards of his country provide for or authorize the purchase of the products offered for sale by GreenValley considering them legal.
Therefore, the user expressly releases GreenValley from any violation of the law in respect of the preceding point and assumes all liability in this respect.
GreenValley informs the User that the products sold / offered for sale by the website are for technical and collectible use and as such cannot be used for any other use / purpose.
The use of the Products for illegal or unauthorised purposes in the jurisdiction of the user is forbidden.
2.3 The transmission of viruses, worms, or any other form of code of a destructive nature through the pages, forms, and code of the Site is forbidden. It is also forbidden to use the Site for illegal, obscene, or immoral purposes, to infringe our or others’ intellectual property rights, or to collect and track the personal information of others.
2.4 Any violation of these terms of use will result in the immediate suspension of the services provided.
2.5 Access to the offers on the Site is permitted exclusively to users who are consumers, as defined in Article 3, para. 1, lett. a) of the Consumer Code and EU Directive 83/2011, meaning natural persons who, in connection with the purchase of Products, are acting for purposes outside their trade, craft, business, or professional activity.
2.6 Under no circumstances may resellers or wholesalers or, in general, any persons intending to purchase Products for professional, commercial, entrepreneurial, handicraft purposes or for subsequent resale, make purchases on the Site. It is therefore forbidden for such subjects to register on the Site and make purchases on the Site.
2.7 GreenValley reserves the right to refuse or cancel orders that come from: (I) a user with whom it has an ongoing legal dispute; (II) a user who has previously breached these General Terms and Conditions of Sale and/or the conditions and/or terms of a purchase contract with GreenValley; (III) a user who has been involved in fraud of any kind and, in particular, credit card payment fraud; (IV) users who have provided false or incomplete identification data.
The above notwithstanding, Green Valley reserves the right to refuse service and to refuse orders to anyone for any reason and at any time.
- Site registration
3.1 Registration on the Site is free of charge. To register on the Site, the user must fill in the registration form, entering his/her name, surname, address, country/region, e-mail address, and password./span>
Registration will be confirmed by e-mail sent to the user who, to complete the registration procedure, must click on the appropriate link contained in the communication received.
3.2 The registration credentials must be used exclusively by the user and cannot be transferred to third parties.
The user undertakes to keep them secret and to ensure that no one has access to them, as well as to inform GreenValley without delay by contacting the Customer Service in case of suspected misuse and / or disclosure of the same. The user guarantees that the personal information provided during the registration process on the Site is complete and truthful. Each user is allowed to register on the Site for one time only. It is forbidden for the same user to make multiple registrations. In the event that GreenValley should detect that the same user has made several registrations on the Site, it reserves the right to proceed, immediately and without prior notice, to block the relevant account. The user agrees to keep GreenValley harmless from any damage, compensation obligation and / or sanction deriving from and / or in any way connected to the user’s violation of the rules on registration on the Site or on the conservation of registration.
3.3 The user is however always given the option of requesting the cancellation of his or her account and data by sending an e-mail to the address privacy@greenvalleysa.it in accordance with the provisions of Legislative Decree 196/2003 and EU Reg. 679/2016.

5.1 In accordance with Legislative Decree No. 70 of 9 April 2003 laying down provisions on electronic commerce, GreenValley informs the user that:
– to conclude the purchase contract for one or more Products on the Site, the user must fill in an order form in electronic format and send it electronically to GreenValley, following the instructions that will appear from time to time once on the Site and which will accompany the different stages of the purchase;;
– the contract is concluded when the order form reaches the GreenValley server;
– before proceeding with the transmission of the order form, the user can identify and correct any data entry errors by following the instructions indicated on the Site from time to time and which will accompany the various stages of the purchase;
– once the order form has been registered and the confirmation of the authorization to pay the total amount due has been received, GreenValley will send the user, via e-mail to the indicated e-mail address, the order confirmation , containing a summary of the General Conditions of Sale and of the special conditions applicable to the contract, information relating to the characteristics of the Product purchased, a detailed indication of the price, the means of payment used, information on the right of withdrawal, delivery costs and any additional costs and Customer Service contacts, which the user can contact to request assistance and / or submit complaints.
It is recommended to keep the e-mail received as proof of purchase. The General Terms and Conditions of Sale applicable to the order, as well as the standard withdrawal instructions and the standard withdrawal form referred to in Article 11 are available on the Site.
The order form will be filed in the GreenValley database for the time necessary to process the order and, in any case, in accordance with the law.
5.2 The languages available to users for the conclusion of the contract are Italian and English.
Customer Service is able to communicate with users in the same languages.
- Prices
6.1 All Product prices are expressed in Euros (€) and are inclusive of Value Added Tax (“VAT”). Shipping costs and any other additional costs, inclusive of VAT and expressed in Euros (€), will be expressly and separately indicated in the order form, before the user proceeds with the transmission of the same, as well as on the e-mail of order confirmation.
6.2 The price of the Products can be changed by GreenValley at any time, without notice, it being understood that the price charged to the user will be the one published on the information sheet that illustrates the main characteristics of the Product (“Product Sheet”) at the time the order is sent.
Any changes (higher or lower) in the price subsequent to the transmission of the order will not be taken into account.
- Purchase Orders – Product Information
7.1 GreenValley will process the purchase order, and therefore will dispatch the purchased Product, only after receiving confirmation of authorization to pay the total amount due, consisting of the purchase price, the delivery costs (if applied) and any other additional costs. In the event that the Total Amount Due is not paid or the successful payment is not confirmed, the purchase contract shall be deemed to be terminated by right pursuant to and for the purposes of Article 1456 of the Italian Civil Code. Of such termination and the consequent cancellation of the order, the user shall be notified immediately after the transmission of the order, through the Site.
7.2The Products will remain the property of GreenValley or its partners until payment by you of the Total Amount Due.
The user acknowledges that GreenValley is in no way responsible for damage, delay, loss of the Product from the moment the Product is entrusted to the courier handling the shipment.
7.3 The Products offered on the Site are the items present on the Site at the time the user places the order.
7.4 Each Product is accompanied by a Product Sheet. The images and descriptions on the Site reproduce the characteristics of the Products as closely as possible. The colors of the Products, however, may differ from the real ones due to the settings of the computer systems or computers used by users for their display. Furthermore, the images of the Product on the Product Sheet may differ in size or in relation to any accessory products. These images must therefore be intended as indicative and with the tolerances of use. For the purposes of the purchase contract, the description of the Product contained in the order form sent by the user will prevail.
- Availability of products
8.1 The products offered on the Site are limited in number. It may therefore happen, also due to the possibility that several users purchase the same Product at the same time, that the ordered Product is no longer available after the transmission of the purchase order. Therefore, once the order request has been received, the Orders department of “GreenValley” reserves the right to reconfirm the availability of the items purchased, the validity of the transaction by credit card and to verify the details of the previous transactions made by the Customer on the website.
8.2 In the event of unavailability of the Product ordered, without prejudice to the rights attributed to the user by law and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code, the user will be promptly informed by e-mail. The user shall then be entitled to cancel the order. In the event that the user avails him/herself of the right of cancellation, GreenValley will refund the amount paid without undue delay and, in any case, within a maximum of 14 working days from the placing of the order. . The amount of the refund will be communicated to the user by e-mail. This amount shall be credited to the same means of payment used by the user for the purchase. Any delays in crediting may depend on the bank, the type of credit card, or the payment solution used. In any case, the value date will be the same as the debit date.
8.3 In the case of orders for several Products (“Multiple Order”), if the unavailability affects only some of the Products in the Multiple Order (without prejudice to the user’s rights under the law, and, in particular, under Chapter XIV of Title II of Book IV of the Civil Code, and subject to the application of art. 8.2 above) and if the unavailability affects all the Products in the order, “GreenValley” will immediately notify the user by email. The user will then be entitled to cancel the order, limited to the Product(s) which have become unavailable in accordance with the provisions of the Consumer Code. In the event that the user decides to cancel the order in relation to the Product(s) which have become unavailable, or in any case in which the payment of the total amount due has already been made, “GreenValley” will refund the amount due in relation to such Product(s) within a maximum period of 14 working days from the completion of the shipment. The amount of the refund will be notified to the user by e-mail. This refund will be made to the IBAN that will be communicated by the User. Any delays in crediting may depend on the bank, the type of credit card or the payment solution used.
In any case, the value date shall be the same as the debit date. The termination of the entire Multiple Order shall only be possible in the event that the Products covered by the Multiple Order are clearly and demonstrably unavailable in relation to the other Products covered by the Multiple Order that are available, a circumstance which GreenValley reserves the right to assess.
- Delivery of purchased products
9.1 The shipping / delivery costs for purchases up to the sum of € 59.00 are subject to payment, while for purchases over the aforementioned amount is free. The amount of the delivery costs payable by the user in relation to a specific order is indicated (in euros and inclusive of VAT) during the purchase process, in the order summary, and, in any case, before the user proceeds to transmit the order.
The indication of these costs will also appear in the “Profile – My orders” section of the Site and in the order confirmation. The delivery terms will be specifically indicated during the purchase process and in the order summary, and, in any case, before the user sends the order. They will also be indicated in the order confirmation and in the “Profile – My orders” section of the Site.
In the event of failure to indicate a specific delivery term, this will in any case take place within thirty days from the date of purchase.
9.2 The delivery obligation is fulfilled by transferring the material availability to the Carrier or otherwise the control of the Products to the user.
It is up to the user to check the condition of the Product delivered to him. The user is advised to check the number of Products received and that the packaging is intact, undamaged, or in any case altered and is invited, in his or her interest, to indicate on the carrier’s transport document, any anomalies, accepting the package with reserve.
Receiving and accepting the Products without reservation does not allow the user to make any claims for attribution of responsibility towards GreenValley and the courier. Without prejudice to the provisions of art. 6.2 In the event that the package shows evident signs of tampering or alteration, the user is also recommended to promptly notify Customer Service. In any case, the application of the rules on the right of withdrawal remains valid. This is without prejudice, in any case, to the application of the rules on the right of withdrawal.
9.3 The Products purchased on the Site will be sent and delivered to the address indicated by the user when ordering. Home Delivery will be made, unless otherwise indicated, by the courier on the days indicated on the site.
“GreenValley” reserves the right to use other carriers, subject to compliance with the delivery method chosen by the user and the delivery terms indicated.
9.4 Upon delivery of the Products to the courier, the user will be sent an e-mail confirming the shipment together with the tracking number through which he/she will be able to check the status of the shipment. This e-mail will also contain the indications relating to the delivery procedure, the deadline for collection in case of non-delivery due to the absence of the recipient and the consequences of failure to collect within the indicated deadline.
9.5 The user acknowledges that the withdrawal of the Product is his specific obligation deriving from the purchase contract. In case of non-delivery due to the absence of the recipient at the address specified in the order form, the courier will leave a postcard to certify the delivery attempt (so-called passage notice). After two unsuccessful delivery attempts, the package will go “in stock”.
As soon as the package is “in stock”, the Customer Service will contact the user in order to unblock the stock and ensure that the package is delivered to him/her as soon as possible. If necessary, the Customer Service may agree with the user to change the delivery address. In the event that the delivery attempt following the Customer Service contact also fails or if the user does not respond to the Customer Service contact attempt, the package will be returned to GreenValley .
With reference to the previous point, the user acknowledges that after thirty (30) days from when the package is returned to GreenValley the contract may be considered terminated and the purchase order canceled pursuant to Article 1456 of the Civil Code. Once the contract has been terminated, GreenValley will proceed to refund the total amount due, if already paid by the User, The refund amount will be credited to the IBAN that will be communicated by the User. Any delays in crediting may depend on the bank, the type of credit card, or the payment solution used. In any case, the value date shall be the same as the debit date. In the event that, prior to the expiry of the aforementioned thirty days, the User wishes to receive the purchased Product again, he/she may contact Customer Service to receive all the information necessary to process the request.
- Methods of payment – Accuracy of information
10.1 Payment for Products can be made by bank transfer, PayPal or using the service Stripe. In the event that one of these means/solutions of payment cannot be used in relation to a specific Product, this will be clearly indicated on the Site, at the latest at the beginning of the purchase procedure.
10.2 he purchase receipt will be issued automatically with each purchase. At the first purchase, the user will be asked to communicate the data for the header of the receipt. For the issuance of the receipt, the information provided for this purpose by the user will prevail, which he declares and guarantees to be truthful, undertaking to keep GreenValley harmless and indemnified from any damage, including penalties issued by the competent authorities, that may derive in the event of non-compliance with the truth of the same.
10.3 The user also undertakes to promptly update his/her account and related information so that transactions can be completed and GreenValley can contact him/her if necessary.
- Right of withdrawal
11.1 The user who acts as a consumer has the right to withdraw from the contract concluded with GreenValley, without having to specify the reason, within fourteen (14) calendar days (Withdrawal Period).
THE ORDER MUST THEREFORE BE RETURNED IN THE METHODS INDICATED BY GreenValley WITHIN AND NOT MORE THAN 14 WORKING DAYS. AFTER THIS TERM THE RETURN WILL NOT BE ACCEPTED.
The Withdrawal Period expires after 14 days:
- a) in the case of an order relating to a single Product: from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the Product;
- b) in the case of a Multiple Order with separate deliveries: from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last Product;
- c) in the case of an order relating to the delivery of a Product consisting of multiple lots or pieces: from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last lot or piece.
11.2 To exercise the right of withdrawal in relation to an Order, the user must inform GreenValleyof his / her decision to withdraw, before the expiry of the Withdrawal Period.
To make the request, simply log in to your area or contact Customer Service and select ‘orders’. You will then need to select the desired order and the product(s) you wish to return. You can complete the return request by filling in the reason for the return and any additional notes. At the end of the procedure, you will be able to print the return receipt to enclose the package and send it to the address provided.
11.3 The user, after having exercised the right of withdrawal in the manner indicated in Articles 11.1, 11.2 above, must return the Product to GreenValley using the carrier indicated. The printed receipt with the return number must be attached to the package.
The return of the Product to GreenValley is the responsibility of the user and the user shall bear the delivery costs for the return of the Product.
11.4 If the user withdraws from the contract in the time and manner indicated, GreenValley will refund the amount paid by the user for the Product 14 calendar days from the day. This date shall be calculated from when the Product arrives at GreenValley’s warehouses.
This is subject to verification of the integrity of the Product. The refund will be made to the IBAN that will be communicated by the User. In any case, the User shall not bear any costs as a consequence of this refund. If the User makes use of the right of withdrawal, the security seal on the Product must not be cut or broken. The Product must not have been opened or altered and must not show any signs of use. The returned product must be returned in the state in which it was delivered.
11.5 In the event that the withdrawal is not exercised in accordance with the applicable law, it will not result in the termination of the contract and, consequently, will not entitle the user to any refund.

12.2 GreenValley will respond to complaints submitted within five working days of receipt of the same.
- Exhaustivity – Applicable law and competent court; out-of-court settlement of disputes – Alternative Dispute Resolution/Online Dispute Resolution
13.1 These General Terms and Conditions of Sale together with the information provided pursuant to Article 49 of the Consumer Code, before the user is bound by the contract, represent the entirety of the agreements between “GreenValley” and the users of the Site with regard to contracts concluded through the Site.
13.2 Contracts concluded between users of the Website and “GreenValley” are governed by Italian law. This is without prejudice to the application to consumer users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided for by the law of the country in which they have their habitual residence, in particular in relation to the deadline for exercising the right of withdrawal, the deadline for returning the Products, in the event of exercising this right, the methods and formalities for communicating the same and the legal guarantee of conformity.
13.3 Please note that in the case of a consumer user, any dispute relating to the application, execution and interpretation of these General Terms and Conditions of Sale shall be settled by the court of the place where the user resides or has elected domicile.
13.4 Pursuant to Article 141-sexies, paragraph 3 of the Legislative Decree of 6 September 2005, no.206 (Consumer Code), GreenValley informs the user who qualifies as a consumer as defined in article 3, paragraph 1, letter a) of the Consumer Code, that, in the event that he or she has made a complaint directly to GreenValley following which it has not been possible to resolve the dispute thus arising, GreenValley shall provide information on the Alternative Dispute Resolution body or bodies for the out-of-court settlement of disputes relating to obligations arising from a contract concluded under these General Terms and Conditions of Sale (the so-called ADR bodies, as referred to in articles 141-bis et seq. d.. ADR bodies, as indicated in Art. 141-bis et seq. of the Consumer Code), indicating whether or not it intends to use these bodies to resolve the dispute.
“GreenValley” also informs the user who qualifies as a consumer under Article 3(1)(a) of the Consumer Code that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. The ODR platform can be consulted at the following address https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage through the ODR platform, the consumer user will be able to consult the list of ADR entities, find the link to the website of each of them and initiate an online dispute resolution procedure for the dispute in which he/she is involved. In any event, the consumer user’s right to bring an action before the ordinary courts having jurisdiction over the dispute arising from these General Terms and Conditions of Sale remains unaffected, whatever the outcome of the out-of-court settlement of disputes relating to consumer relations through recourse to the procedures set out in Part V, Title II-bis of the Consumer Code.
13.5 A user residing in a member state of the European Union other than Italy may also have access, for any dispute relating to the application, execution and interpretation of these General Terms and Conditions of Sale, to the European Small Claims Procedure established by Council Regulation (EC) No. 861/2007 of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, fees and expenses, Euro 2,000.00. - Intellectual Property
14.1 The website as a whole, the products sold on the website and their packaging, and all elements that can be found on the website (such as trademarks, logos, designs, shapes and models, illustrations, photos, texts, animations, videograms, phonograms, software, source codes and databases) are the exclusive property of GreenValley or the owners of the intellectual property rights of the item in question. All these elements are protected by copyright, trademark law, industrial design law, patent law and sui generis rights.
14.2 Consequently, any reproduction, communication, download, modification or partial and total use of these elements belonging to GreenValley or to third parties, for any purpose or by any means of communication, requires prior written authorization from GreenValley or the respective owners of the intellectual property rights, except in cases where it is authorized by law. The Customer declares and warrants that he/she has been informed that failure to comply with any of these obligations will expose him/her to civil action and / or criminal proceedings.
